One of the key variables in the implementation of the innovations brought by the Occupational Health and Safety Law and in ensuring effectiveness in OHS services, by examining the common and separate features of the laws based on the Mining Law and the Occupational Health and Safety Law, what the criminal and legal responsibilities are, the determination of the distribution of duties in the mining area. By giving information about whether the duties of the security specialist and the permanent supervisor are the same, it is shown what the duties and responsibilities of the permanent supervisor are arising from the legal regulations and the criminal or legal situation that overlaps with which law article. The most striking aspect of all legal regulations on mining is that, due to the intertwining of criminal and legal regulations, it causes confusion in many stages of the legal trial of the permanent supervising mining engineer within the scope of the incident, especially in a work accident that occurs.
