5846 sayılı Fikir ve Sanat Eserleri (FSEK) kapsamında müzik eserleri, her türlü sözlü ve sözsüz besteler olarak tanımlanmaktadır. Bu kapsamda, şarkılar sözlü müzik eserleri olarak anılmaktadır. Şarkılar hem beste yani müzik, hem güfte yani söz hem de aranjman gibi unsurlar içerebildiğinden çok yönlü telif hakkı korumasına tabidir. Esinlenme, ilham almak anlamına gelmekte olup eser sahibinin yaratıcılık sürecinin doğal bir sonucudur. Yaratıcılık sürecinde eser sahibinin kaçınılmaz olarak diğer eserlerden etkilenmesinin hangi noktada esinlenme sınırlarını aşıp intihal olarak değerlendirileceği de önem arz etmektedir. Fikri mülkiyet hukukunda esinlenme halinde, eser sahibi başka bir eserden ilham alarak kendi hususiyetini taşıyan özgün bir eser ortaya çıkarmaktadır. Bunun sonucunda ortaya çıkan müzik eserleri özelinde şarkıların telif hakkını ihlal etmemesi için, ortaya çıkan eserin kaynak eserden açıkça ayırt edilebilir olması ve sahibinin hususiyetini taşıması gerekmektedir. Çalışmamızda, müzik eserleri özelinde şarkılarda esinlenme hali yargı kararları çerçevesinde değerlendirilecektir.
Within the scope of Intellectual and Artistic Works numbered 5846, musical works are defined as all kinds of compositions with or without lyrics. In this context, songs are referred to as musical works with lyrics. Since songs can contain elements such as composition, namely music, lyrics, and arrangement, they are subject to multifaceted copyright protection. Inspiration means being inspired and is a natural result of the creative process of the author. It is also important at what point the author’s inevitable influence from other works in the creative process exceeds the limits of inspiration and is considered plagiarism. In the case of inspiration in intellectual property law, the author creates an original work that bears his/her own characteristics by taking inspiration from another work. As a result, in order for the resulting musical works, specifically songs, not to violate copyright, the resulting work must be clearly distinguishable from the source work and must carry the characteristics of the owner. In our study, the state of inspiration in musical works, specifically songs, will be evaluated within the framework of judicial decisions.
